Who must give way on a motorway or any other road in New South Wales when moving from one lane of traffic to another?

When lane merging on a motorway it is important to note the following:

  • A driver who is merging from one lane separated by broken lines, to another lane of traffic (whether or not the lane is ending) must give way (i.e. slow down and, if necessary stop to avoid a collision) to any vehicle travelling in the second lane of traffic.

When moving from one line of traffic to another line of traffic when the lines are not merging:

  • A driver who is merging into one or more lines of traffic travelling in the same direction must give way to a vehicle in another line of traffic if any part of the vehicle is ahead of the driver's vehicle.
