Driver training workshop terms and conditions

1. Product Offer

In these terms and conditions NRMA Safer Driving Schools Pty Limited ACN 122 086 248 (“NRMA”) is referred to as "we", "our" and "us”.

a. You will be participating in the Driver Training workshop (“Workshop”) provided by NRMA. The Workshop consists of two components, a 3 hours in classroom session at an NRMA designated location (“Theory”) and a 90 minute practical driving session on public roads (“Practical”) nearby to the classroom location.

b. To enrol in a Workshop you must be between 18 and 75 years of age, and hold a current Australian driver’s license.

c. NRMA has the right to cancel or postpone a Workshop session if a minimum number of participants have not registered. NRMA will provide 48 hours’ notice of any cancellation or postponement of a Workshop, and you will be able to elect to reschedule or to receive for a refund if we are unable to provide a suitable replacement date and location. 

d. You must bring your current driving licence to the Workshop. If you do not do so, you may complete the Theory element but you will not be eligible to complete the Practical element of the Workshop on that day. Depending on the availability of spaces in further Workshops, you may be able complete the Practical on an alternative day.    

e. By registering for and undertaking the Workshop, you consent to receive further communications (including electronic communications) from the NRMA Group. Your information will be treated in accordance with the NRMA Privacy Policy. This can be found at www.mynrma.com.au. 

2. Payment conditions

a. All bookings must be paid for in full prior to the commencement of the Workshop.

b. We accept credit/debit cards (Visa, Mastercard via our secure payment gateway or Paypal). 

c. By booking the Workshop, you warrant to us that you are 18 or more years of age, and that all information given by you to us through any booking channel (including your name, contact and address details) is correct.

3. Cancelation Policy:

a. If you want to cancel your attendance at the Workshop with more than seven days’ notice, you will receive a full refund of the Workshop fee. 

b. If you cancel within 7 days of your attendance at the Workshop your full fee will be subject to forfeit.

c. If you need to reschedule within the 7 days prior to your scheduled Workshop, NRMA will make all reasonable attempts to reschedule to a suitable alternative session time and date. 

d. If we are unable to reschedule the Workshop session and/or you wish to cancel, then you forfeit the full course fee.

4. Our right to terminate 

We reserve the right at our reasonable discretion to refuse to provide training where we deem an individual undertaking the Workshop as unfit to partake in the Workshop (including but not limited to the ability to operate a vehicle). 

We reserve the right to terminate participation in the Workshop if:  

a. You engage in any behaviour that our trainer determines is reckless; or 
b. You fail to comply with the instructions or directions of the trainer or assessor before or during the Workshop; or 
c. You fail to comply with any special conditions on your licence (including but not limited to the wearing of glasses / contact lens); or 
d. The trainer has assessed your driving skills and competence and deems them to be unfit or unsafe to drive (and see also the section "Fitness to drive" below). 

If your participation training is terminated under the circumstances listed above you may forfeit the full fee at NRMA’s discretion. 

5. PROVISION OF WORKSHOP 

When undertaking the Workshop: 

a. You will at all times follow all reasonable instructions of our trainer; 

b. We will provide you with materials such as workbooks and information sheets for the Workshop. The information provided is general information and we do not guarantee the accuracy of the information as it may vary over time.  In particular, if NRMA makes reference to any specific vehicle in the course, the details may have changed since the course publication date and you should consult the manufacturer manuals for details relating to specific vehicles. 

c. Upon completion of the course you will receive an A4 PDF certificate via email.  This certificate is a certificate of attendance and is not to be construed as a representation of any particular level of driving skill or qualifications. 

d. You will be responsible for the safety of your personal property on the day. Any loss, damage, liability, costs and expenses in connection with your personal property this will be your responsibility, and neither we nor our driving assessors accept any liability whatsoever for personal property that is left in any assessor supplied vehicle, your vehicle or on our premises. 

6. COMMENCEMENT OF WORKSHOP 

a. You must be ready to commence the Workshop 10 minutes prior to the start time, as the Workshop session will not be delayed. If you turn up more than 30 minutes after the scheduled start time, then the trainer may in their reasonable discretion refuse you entry to the classroom, and in such circumstances you may forfeit the full fee. 

b. Whilst we aim to and will endeavour to commence the Workshop at the scheduled time and with the scheduled trainer, no responsibility is taken for any circumstances beyond our control which may delay the start time or result in a change of trainer. If there are circumstances beyond our control which have delayed the start time of your Workshop and you cannot attend as a result, then we may offer you training at another time or you may elect for a refund.  

7. INTELLECTUAL PROPERTY

You agree that we own the intellectual property rights in all material provided to you under the Workshop. You agree that the intellectual property rights in any material created by you or us during the Workshop including modifications or improvements made to the material provided to you by us will vest in us. 

8. VEHICLES 

Use of NRMA vehicle: Generally the Workshop Practical will be provided using NRMA supplied vehicles (“NRMA Vehicles”).  Any on-road driving sessions using NRMA Vehicles are provided in automatic transmission vehicles.

NRMA Vehicles may contain global positioning and monitoring systems with the capacity to identify the location of the vehicle and the manner in which it is operated.

Use Of Own Vehicle: if you elect to drive your own vehicle or company vehicle during the Practical, then the trainer will conduct a basic external inspection to satisfy themselves that the vehicle is roadworthy. No representation is made by NRMA or any trainer as to the suitability of the vehicle, however the following requirements must be met in relation to the vehicle: 

a. The registration of the vehicle must be valid, current, intact and visible. 

b. You must hold current compulsory third party insurance and comprehensive insurance cover for the vehicle;  
c. You must have notified your insurance company in writing prior to undertaking the Workshop that the vehicle being used will be used to provide driving training.

d. The tyres are correctly inflated (air pressures must reflect the manufacturer's recommendation as a minimum), have appropriate levels of tread and are not damaged;

e. All indicators and brake lights are working;  

f. Seats and seat belts are in good working order and are not damaged or twisted;  

g. Any loose items in the cabin of the vehicle are stored in the cargo (boot) area;

h. The windows and interior are clean;

i. The windscreen is not cracked and shows no signs of damage; and  

j. The vehicle has sufficient petrol to last the course of the training, with the minimum requirement being a quarter of a tank. 

9. FITNESS TO DRIVE 

a. To undertake the Practical you must hold a current NSW/ACT driving licence (Class C LRN or C) or equivalent overseas licence and carry it with you at all times during the Practical. 

b. In the interests of safety, the trainer may make an assessment of your driving skills and competence at any time during the Practical part of the Workshop. If at any time you are assessed as being unfit or unsafe to drive during the Practical, the trainer may terminate the training immediately and assume control of the vehicle. 

c. When attending the Workshop you must dress in a manner appropriate to the situation. Thius includes (but is not limited to) the requirement that you do not wear high heels, thongs or other footwear which in the opinion of the trainer or assessor may cause safety concerns. A flat, enclosed and secure shoe is recommended. 

d. You must turn off your mobile phone prior to starting the Practical in the vehicle. 

10. LIMITATION OF LIABILITY 

Certain State and Commonwealth legislation, including the Competition and Consumer Act 2010 (Cth), imply warranties or conditions or impose obligations which cannot be excluded, restricted or modified except to a limited extent. These terms and conditions do not purport to exclude any statutory rights available to you and must in all cases be read subject to those statutory provisions.

You will indemnify us if we suffer any loss or damage or incur any costs in connection with your breach of these terms or any other legal obligation by you in relation to your participation in the Workshop.

To the extent permitted by law, our liability for breach of any implied warranty or condition which cannot be excluded is restricted, at our option, to either the re-supply of those services, or the payment of the cost of having those services re-supplied.

You indemnify and agree to keep us and our related bodies corporate and our and their officers, employees, contractors, franchisees and agents indemnified against any loss, damage, liability, costs and expenses in connection with your breach of these terms and conditions or any other legal obligation by you in relation to your participation in the Workshop. 
 
If any part of the Workshop takes place in your own vehicle, you warrant that you are covered by compulsory third party insurance and that your vehicle is covered by comprehensive insurance and has current registration
